Terms of Use for Aquapal AI

1. Agreement to Terms Welcome to Aquapal AI ("Service," "we," "our," or "us"), provided by Jack Park. By accessing or using our Service, you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must discontinue your use of the Service immediately.
2. Eligibility and Age Requirements You represent and warrant that you are at least 13 years old. Our Service is not intended for individuals under the age of 13. If you are between 13 and 18 years old (or the age of legal majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian.
3. Account Registration To use certain features of the Service, you must register using third-party authentication services (Apple or Google). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate or violates these Terms.
4. Aquarium Management and Livestock Disclaimer The water quality indicators (such as ammonia and nitrite levels) and management guides analyzed and provided by Aquapal AI are intended solely as supplementary data to assist in the efficient management of your primary aquarium. They do not constitute definitive veterinary diagnoses or professional aquatic advice. You acknowledge that managing an aquarium involves inherent variables and risks to aquatic life. We do not guarantee that the water quality analysis or guides will be 100% accurate, complete, or prevent issues in your aquarium. To the maximum extent permitted by law, Jack Park and Aquapal AI shall not be held legally responsible or liable for any illness, health deterioration, loss, or death of any fish, aquatic life, or livestock, nor for any aquarium equipment failures or damages that may occur while using the Service.
5. User Content and AI Training By uploading, submitting, or generating text, images, or other data ("User Content") through Aquapal AI, you represent that you own or have the necessary rights to such content. You grant us a worldwide, irrevocable, royalty-free, transferable, and sublicensable license to use, reproduce, process, modify, and analyze the User Content to operate, maintain, and improve the Service. This includes utilizing your data to train, test, and enhance our artificial intelligence models and algorithms.
6. Prohibited Conduct You agree not to use the Service to:
Upload or generate unlawful, harmful, explicit, or infringing content.
Reverse engineer, decompile, or attempt to extract the source code or AI models of the Service.
Interfere with or disrupt the security, integrity, or performance of the Service.
7. Intellectual Property All rights, title, and interest in the Service (excluding User Content), including its software, AI algorithms, design, and trademarks, are owned exclusively by Jack Park. You may not copy, modify, distribute, or create derivative works from any part of the Service without our express written consent.
8. Disclaimer of Warranties THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service or AI-generated responses will be accurate, error-free, or continuously available.
9. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR DATA. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE INCIDENT, OR (B) ONE HUNDRED US DOLLARS ($100.00).
10. Arbitration and Class Action Waiver Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration. Class actions and representative actions are not permitted. You agree to waive your right to a trial by jury and your right to participate in a class-action lawsuit.
11. Termination We may suspend or terminate your access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
12. Changes to These Terms We reserve the right to modify these Terms at any time. Material changes will be communicated to you through reasonable notice (e.g., within the app). Your continued use of the Service after such updates constitutes your acceptance of the revised Terms.
